Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Entrepreneur: The natural or legal person who offers products to consumers remotely;
  • Consumer: The natural person who does not act for purposes related to his trade, business, craft or profession;
  • Distance contract: An agreement concluded between the entrepreneur and the consumer within the framework of an organized system for distance sales of products, whereby, up to and including the conclusion of the agreement, exclusively one or more techniques for remote communication are used;
  • Reflection period: The statutory period of 14 days during which the consumer can exercise his right of withdrawal (subject to the legal exclusions for foodstuffs);
  • Right of withdrawal: The consumer's option to waive the distance contract within the reflection period;
  • Day: Calendar day;
  • Durable data carrier: Any means – including email – that enables the consumer or entrepreneur to store information in a way that allows future consultation.

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
  3. If the distance contract is concluded electronically, the text of these general terms and conditions may be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier.

Article 4 - The offer

  1. If an offer has a limited period of validity (such as a temporary promotion or best-before date discount), this will be explicitly stated with the product.
  2. The offer contains a complete and accurate description of the products. The description is sufficiently detailed to enable a good assessment by the consumer.
  3. Images are a true representation of the products. Obvious mistakes or errors in the offer (such as obvious pricing errors) do not bind the entrepreneur.

Article 5 - The agreement

  1. The agreement is concluded at the moment the consumer places the order in the webshop and meets the conditions set for it (such as payment).
  2. The entrepreneur will immediately confirm receipt of the order electronically (email).
  3. The entrepreneur ensures a secure web environment for placing the order and payment.

Article 6 - Right of withdrawal & Unaccepted deliveries

  1. The consumer has the right to dissolve an agreement regarding the purchase of a product during a reflection period of 14 days without stating reasons, provided that the product is not excluded in accordance with Article 10.
  2. Unaccepted or uncollected shipments: If a shipment is returned to Snoepislekker.nl by the carrier because it was refused by the consumer, not found at home, or not collected from a parcel point within the specified period, the order will be cancelled in accordance with the provisions in Article 13.
  3. The original shipping costs and any return costs incurred by the transport service will be deducted from the refund for an uncollected or refused delivery.

Article 7 - Obligations of the consumer during the reflection period

  1. During the reflection period, the consumer will handle the product and its packaging with care. He will only unpack the product to the extent necessary to establish the nature and characteristics of the product (as in a physical store).
  2. The consumer is liable for any depreciation of the product resulting from handling the product in a way that goes beyond what is permitted in paragraph 1.
  3. Please note: Breaking the factory seal, outer box, or shrink wrap of foodstuffs and beverages leads to a 100% depreciation due to hygiene and food safety reasons.

Article 8 - Exercise of the right of withdrawal by the consumer and costs thereof

  1. If the consumer makes use of his right of withdrawal for products not excluded under Article 10, he must notify the entrepreneur by email (info@snoepislekker.nl) or using the model form within the reflection period.
  2. As soon as possible, but within 14 days after this notification, the consumer will return the product in its original, unopened condition and factory packaging.
  3. The risk and burden of proof for the correct and timely exercise of the right of withdrawal lie entirely with the consumer.
  4. The consumer bears the direct costs of returning the product.

Article 9 - Obligations of the entrepreneur in case of withdrawal

  1. If the entrepreneur enables the consumer to notify them of withdrawal electronically, they will send an acknowledgment of receipt without delay after receiving the notification.
  2. The entrepreneur will reimburse the consumer's payments for the returned product without delay, but within 14 days following the day on which the consumer notifies them of the withdrawal, provided the product has been received in good order.
  3. The entrepreneur will use the same payment method for reimbursement as the consumer used.

Article 10 - Exclusion of the right of withdrawal (Food Safety, Hygiene & Customization)

The entrepreneur excludes the following products from the right of withdrawal, as legally permitted (Article 6:230m Dutch Civil Code):

  1. Hygiene and Health Protection: Sealed foodstuffs and beverages (such as bags of candy, silo packaging, cans, trays, and consumed goods) of which the packaging or seal has been broken after delivery. These absolutely cannot be returned or credited for reasons of food safety and hygiene.
  2. Pick-and-Mix Candy & Sweet Bags (Customization): Candy that has been manually put together, weighed, or individually wrapped at the consumer's request (such as pick-and-mix candy mixes and candy bags).
  3. Freeze-dried products & Extremely fragile candy: Products whose quality or form cannot be guaranteed after unpacking due to their extremely brittle nature.
  4. Best-before date (BBD) items and date promotions: Products offered at a discount because the BBD is approaching or has passed, provided this is explicitly stated in the product title or description.
  5. Business customers: The right of withdrawal applies only to consumers and is excluded for business orders.

Article 11 - The price

  1. During the validity period stated in the offer, the prices of the products offered will not be increased, except for price changes due to changes in VAT rates.
  2. The prices mentioned in the product offer include VAT.
  3. All prices are subject to printing and typesetting errors. No liability is accepted for the consequences of such errors.
  4. The prices do not include shipping costs. The applicable minimum order amount of € 10.00 (excluding shipping costs) will be clearly communicated to the consumer before completing the order.

Article 12 - Fulfillment of the agreement and additional warranty

  1. The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, and the legal provisions regarding food safety.
  2. Slight cosmetic damage to the exterior of cans (such as a small dent due to transport) that does not affect the function, shelf life, or taste of the product is not covered by the warranty.

Article 13 - Delivery, Pre-orders & Execution

  1. The place of delivery is the address that the consumer has made known to the entrepreneur.
  2. Accepted orders will be executed with due speed, but at the latest within 30 days, unless a different delivery period (as in the case of a pre-order) has been agreed upon.
  3. Pre-orders: The entrepreneur offers the possibility to reserve products that are not yet in stock in advance (Pre-order). The stated delivery time for a pre-order is always an indication (depending on international shipping and customs). The consumer has the right to cancel a pre-order at any time free of charge as long as it has not yet been handed over to the carrier.
  4. Combination orders: If an order contains both immediately available products and pre-order products, the entire order will only be shipped once the pre-order products are in stock.
  5. Handling in case of failed delivery: If a package is not accepted or not collected from a parcel point and is returned to Snoepislekker.nl:
    • Reshipment: Can take place at the consumer's request after the costs for the second shipping attempt (€6.65 NL / €9.95 BE) have been paid via a payment link.
    • Final cancellation: In case of cancellation, Snoepislekker.nl will credit the purchase amount of the products eligible for return (in accordance with Article 10). The original shipping costs and any return costs charged by the courier will not be credited.

Article 14 - Sale of alcoholic beverages (18+)

  1. Age limit: Snoepislekker.nl sells alcoholic beverages (such as Monster 'The Beast') exclusively to persons aged 18 and over.
  2. Age verification upon delivery (NIX18): The parcel delivery service will perform a mandatory age check upon delivery. The recipient must show a valid ID (passport, ID card or driving license).
  3. Refusal of delivery: If a valid ID cannot be shown at the door or the recipient is a minor, the package will not be delivered and will not be delivered to neighbors. In that case, the shipping and return costs incurred will be borne by the buyer.

Article 15 - Payment

  1. Due amounts must be paid directly when placing the order via the payment methods offered in the webshop.
  2. The consumer is obliged to report inaccuracies in provided or stated payment details to the entrepreneur without delay.

Article 16 - Complaints procedure

  1. Complaints about the execution of the agreement or damaged deliveries must be submitted as soon as possible and within a reasonable time after the consumer has discovered the defects, fully and clearly described, via info@snoepislekker.nl (preferably including photos of the box and contents).
  2. Complaints will be answered within a period of 14 days from the date of receipt.

Article 17 - Disputes

  1. Dutch law applies exclusively to agreements between the entrepreneur and the consumer to which these general terms and conditions relate.
  2. Consumers can also use the European ODR platform (Online Dispute Resolution) via http://ec.europa.eu/consumers/odr/.

Article 18 - Additional or deviating provisions

Additional provisions or provisions deviating from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing.

Article 19 - Amendment of the general terms and conditions

  1. Changes to these terms and conditions are only effective after they have been published on the website.
  2. These general terms and conditions were last amended on August 14, 2026.
